Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  1. Cooling-off period: the period within which the consumer can exercise their right to return;
  2. Consumer: the individual, who as a natural person, enters into an agreement with Sieradenmeisje;
  3. Day: calendar day;
  4. Right of withdrawal: the possibility for the consumer to withdraw from the agreement within the legal period;
  5. Entrepreneur: the natural or legal person offering products or services to consumers;
  6. Distance contract: an agreement where exclusively digital communication is used;
  7. General terms and conditions: the applicable General Terms and Conditions of Sieradenmeisje.

Article 3 – Applicability 

  1. These general terms and conditions apply to every offer from Sieradenmeisje and to every agreement between Sieradenmeisje and the consumer.
  2. Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer or can be easily found by the consumer via sieradenmeisje.nl.
  3. These general terms and conditions can be saved by the consumer.
  4. If one or more provisions in these general terms and conditions are amended at a later date, the agreement will remain in force for the remainder.
  5. Situations not provided for in these general terms and conditions, or ambiguities about their content, will be assessed ‘in the spirit’ of these general terms and conditions.

Article 4 – The offer

  1. If an offer has a limited duration or has specific conditions, this will be stated in the offer.
  2. The offer is without obligation and Sieradenmeisje may change the offer.
  3. The offer contains a complete description of the products offered. The description is detailed enough to enable the consumer to make a proper assessment.
  4. Errors or mistakes in the offer do not bind Sieradenmeisje.
  5. All images and specifications in the offer are indicative and cannot lead to compensation or termination of the agreement.
  6. Images accompanying products are a true representation of the products. Sieradenmeisje cannot guarantee that the colors displayed exactly match the real colors of the products. 
  7. There is sufficient information available for each offer, so that it is clear to the consumer what rights and obligations are attached to the offer. This concerns in particular:
  • the price including taxes;
  • the shipping costs;
  • the way in which the agreement will be concluded;
  • whether the right of withdrawal applies;
  • the method of payment, delivery, and execution of the agreement;
  • whether the agreement is archived and how it can be consulted;
  • how the consumer can check and adjust their data; and
  • the codes of conduct to which Sieradenmeisje subscribes and where the consumer can consult these codes of conduct.

Article 5 – The agreement

  1. The agreement is concluded when the consumer places an order.
  2. When the consumer places an order, Sieradenmeisje confirms receipt of the order.
  3. Sieradenmeisje ensures a secure digital environment and secure data transfer.
  4. Within legal frameworks, Sieradenmeisje may check whether the consumer can meet their payment obligations and become informed of facts and factors necessary for the responsible conclusion of the agreement. If Sieradenmeisje has good reasons based on this information not to enter into the agreement, Sieradenmeisje has the right to refuse an order or request or to attach special conditions to it.
  5. Sieradenmeisje will make the following information available or obtainable to the consumer regarding the product or service:
    a. where the consumer can go with questions or complaints;
    b. whether and how the consumer can exercise the right of withdrawal;
    c. information about warranties after purchase;
    d. the product information referred to in article 4 paragraph 3, unless this information has already been provided to the consumer before the execution of the agreement.

Article 6 – Right of withdrawal

  1. In the purchase of products, the consumer may dissolve the agreement without giving reasons within 14 days. This cooling-off period starts on the day after the consumer receives the product or a representative of the consumer.
  2. During the cooling-off period, the consumer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product.
  3. If the consumer makes use of the right of withdrawal, he will return the product with all accessories supplied and in its original condition and packaging to Sieradenmeisje, in accordance with Sieradenmeisje's instructions.
  4. If the consumer wishes to exercise his right of withdrawal, he is obliged to inform Sieradenmeisje of this within 14 days after receiving the product. This can be done by email or via the return form.
  5. After the consumer has notified Sieradenmeisje that he wishes to return the product, he must return the product within 14 days. The consumer must prove that the delivered products have been returned on time by means of a proof of shipment.
  6. If the customer does not inform Sieradenmeisje of his intention to exercise his right of withdrawal or does not return the product to Sieradenmeisje after the periods mentioned in paragraphs 4 and 5, the purchase is final.

Article 7 – Costs in case of withdrawal 

  1. If the consumer makes use of his right of withdrawal, the costs of return will be at his expense.
  2. Sieradenmeisje will refund the paid order amount as soon as possible, but no later than 14 days after withdrawal, provided that the product has been returned to Sieradenmeisje.
  3. Repayment will be made via the same payment method used by the consumer, unless the consumer and Sieradenmeisje agree otherwise.
  4. In the event of damage to the product due to careless handling by the consumer, the consumer is liable for any depreciation of the product's value. Sieradenmeisje will investigate the damage and deduct the amount for repair work from the refunded order amount.

Article 8 – Exclusion of right of withdrawal

  1. Sieradenmeisje excludes the right of withdrawal for products:
    a. which have been made or adapted by Sieradenmeisje according to the consumer's specifications, such as 'made-to-order' products and custom-made products such as a customized ring size or length of a bracelet or necklace; or
    b. which are clearly of a personal nature.
  2. Sieradenmeisje excludes the right of withdrawal for products with a financial value that can be spent in the webshop, such as:
    a. digital or paper gift vouchers and credit notes.

Article 9 – Pricing

  1. The prices mentioned in the offer of products or services include VAT.
  2. All prices are subject to technical errors and printing and typing errors. Sieradenmeisje is not obliged to deliver the product for the incorrect price.

Article 10 – Conformity and Warranty

  1. Sieradenmeisje ensures that the products comply with the agreement, the product information provided with the offer, and the reasonable requirements of soundness or usability.
  2. Incorrectly delivered products must be reported to Sieradenmeisje in writing within 14 days of delivery. The products must be returned in the original packaging and condition.
  3. Second-hand products are eligible for a 1-month warranty.
  4. New products are eligible for a 3-month warranty.
  5. The warranty does not apply if:
    a. the consumer has repaired or altered the delivered products themselves, or has had them repaired or altered by third parties; or
    b. the delivered products have been exposed to abnormal conditions or handled carelessly.

Article 11 – Delivery and execution

  1. Sieradenmeisje will be careful in receiving and executing orders and in assessing applications for the provision of services, such as adjusting the ring size.
  2. The place of delivery is the address communicated by the consumer to Sieradenmeisje, or a pick-up point chosen by the consumer of a transport service.
  3. Sieradenmeisje will execute accepted orders with diligence, but no later than within 30 days, unless the consumer has agreed to a longer delivery period.
  4. All delivery times are indicative. The consumer cannot derive any rights from the mentioned deadlines. Exceeding a delivery deadline does not entitle the consumer to compensation.
  5. If delivery of an ordered product proves to be impossible, Sieradenmeisje will attempt to provide a replacement item.
  6. The risk of damage or loss of products rests with Sieradenmeisje until the moment of delivery, as described in section 7.
  7. The moment of delivery is when the transportation service has recorded the delivery as completed.

Article 12 – Payment

  1. The consumer must settle the amounts owed or have entered into a payment agreement via Klarna (pay later) before Sieradenmeisje proceeds with delivery.
  2. The consumer is obligated to report inaccuracies in provided or stated data to Sieradenmeisje.
  3. In the event of the consumer's default, Sieradenmeisje has the right to charge costs.

Article 13 – Complaints procedure

  1. Complaints about the execution of the agreement must be submitted in full and clearly described to Sieradenmeisje within 14 days after the consumer has discovered the defects.
  2. Complaints submitted to Sieradenmeisje will be answered within 14 days from the date of receipt. If a complaint requires a longer processing time, Sieradenmeisje will provide an indication of when the consumer can expect a more detailed response.
  3. In the event of complaints, the consumer must first contact Sieradenmeisje. If no resolution can be reached, the consumer has the option to have their complaint handled by an independent dispute resolution committee. The decision of this committee is binding, and both Sieradenmeisje and the consumer agree to this binding decision. Costs associated with submitting a dispute to the dispute resolution committee must be paid by the consumer to the relevant committee.
  4. A complaint does not suspend Sieradenmeisje's obligations, unless otherwise indicated by Sieradenmeisje.
  5. If a complaint is found to be valid by Sieradenmeisje, Sieradenmeisje will choose to replace or repair the delivered products. If replacement or repair is not possible, Sieradenmeisje will provide a voucher or, based on the nature of the complaint, proceed with a refund.

Article 14 – Dutch law

  1. Dutch law exclusively applies to agreements between Sieradenmeisje and the consumer to which these general terms and conditions apply, even if the consumer resides abroad.
